Banking Regulation

Fintech Company — BNM Money Services Business Licensing

The Challenge

A Kuala Lumpur-based payments company needed to obtain a money services business licence from BNM. They had a previous application that was returned incomplete and were uncertain how to proceed. Their existing corporate structure also needed to be assessed against BNM fit-and-proper requirements before resubmission.

Our Approach

Pallworth reviewed the returned application in full, identified the gaps in documentation and policy evidence, and prepared a comprehensive compliance package including AML/CFT programme documentation, internal governance policies, and a revised business plan with the required regulatory content. The resubmission addressed BNM's outstanding queries directly.

The Outcome

The application was accepted and progressed to the approval stage within ten weeks of resubmission. The client received their MSB licence and was able to launch operations on their planned timeline. The engagement included ongoing advisory support in the months following licensing.

Data Privacy & Protection

Healthcare SME — PDPA Compliance Programme

The Challenge

A private healthcare organisation operating across three clinics in the Klang Valley had no formal data protection policy and was handling patient records, referrals, and appointment data without documented consent procedures. A partner referral raised concern about exposure under PDPA.

Our Approach

We conducted a data mapping exercise across all three sites, identified the categories of data collected, and assessed each against the PDPA principles. We then drafted a privacy notice, internal data handling protocol, patient consent form, and a data retention schedule. Staff briefings were delivered to clinical and administrative teams.

The Outcome

The organisation now operates with documented, PDPA-aligned procedures across all sites. The principal noted that the process also helped clarify internal data responsibilities — a benefit beyond legal compliance. The engagement was completed within five weeks and came in at the agreed fixed fee.

Construction & Infrastructure Law

Subcontractor — CIPAA Adjudication and Negotiated Settlement

The Challenge

An M&E subcontractor was owed approximately MYR 380,000 in unpaid progress claims from a main contractor, who disputed both the amount and an extension of time request. The subcontractor needed to pursue recovery without disrupting their ongoing relationship with the developer above.

Our Approach

Suraya reviewed the contract, the payment claims, and the contractor's written responses. She prepared a CIPAA adjudication referral that laid out the entitlement to payment clearly and addressed the extension of time position. Rather than filing immediately, the referral was used as the basis for a structured negotiation, which both parties preferred.

The Outcome

A settlement of MYR 345,000 was reached within six weeks, avoiding a formal adjudication hearing. The client accepted the negotiated sum as a practical outcome that resolved the matter without further delay or proceeding costs. The contractor relationship remained workable.
